ACKNOWLEDGEMENT OF RISK, WAIVER OF LIABILITY, RELEASE

THIS IS A RELEASE OF LIABILITY—YOU MUST READ AND FULLY UNDERSTAND THIS BEFORE SIGNING.

In consideration of my ability and that of my minor child, to use the services offered by Runsnwickets Inc., (Company) including the facility located at 315 Roycefield Road, Hillsborough, NJ 08844, and participation in enjoyment of the services and activities, including but not limited to, cricket, food and beverage facilities and any and all other spaces and activities and any third-party vendor or event held by the Company inside or outside of the physical building provided by the Company, operator of the facility, its agents, owners, officers, employees (“Releasees”), the undersigned hereby agrees as follows:

ASSUMPTION OF RISK:

I HEREBY ASSUME ALL OF THE RISKS FOR ME AND MY MINOR CHILD FOR PARTICIPATING IN CRICKET AND/OR ANY OTHER SPORT PRACTICE, COMPETITION, OR RELATED ACTIVITIES OR EVENTS ON OUR PREMISES INCLUDING SPECTATING, and waive, release and discharge the Company as well as their directors, board members, officers, employees, volunteers, agents, representatives or assigns and the activity or event sponsors, from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons release, for death, disability, personal injury, property damage, property theft, or actions of any kind which may occur to me or my minor child as a result of participation in the above named activity at the facility or outside the facility. I agree to indemnify, hold harmless, and promise not to sue the entities or persons of the Company from any and all liabilities or claims made as a result of participation in this activity or event, whether caused by the negligence of those released or otherwise. I understand and agree that cricket or any other sport are inherently dangerous activities, and it is not possible to protect from all hazards or sources of injury.

RELEASE AND WAIVER OF CLAIMS AGREEMENT:

In consideration of allowing me and my minor child to participate in the activities offered by the Company, I hereby, for myself and for my minor child, to the fullest extent permitted by law:

1. WAIVE ANY AND ALL CLAIMS that I and my minor child have or may have in the future against each of the Releasees resulting from me or my minor child’s participation in the activities offered by the Company.

2. RELEASE each of the Releasees from any and all liability for any loss, damage, injury, death, or expense that I (or my next of kin) or if applicable, my minor child (or his/her next of kin) may suffer, as a result of mine or my minor child’s participation in any activity offered by the Company, mine or my minor child’s presence at the Facility, use of equipment and games located at the Facility or outside the Facility whether described in this Agreement or not, due to any cause whatsoever.

3. INDEMNIFY and hold harmless the Releasees against any and all liability, loss, expense, including reasonable attorneys’ fees, or claims for injury or damages arising out of mine or my minor child’s participation in any activities at the Facility, our presences at the Facility, all as described in this Agreement, whenever and however they occur.

The Company reserves the right to deny participation to any person for any reason, including, but not limited to, failure to complete and sign this Acknowledgement of Risk, Waiver of Liability, and Release form, failure to follow rules and regulations established by the Company, failure to follow directions and instructions, display of attitude, actions that the Company deems to be detrimental to its business or to other patrons, possession of banned or illegal substances, or engaging in unsafe or erratic behavior. In such instance, the Company reserves the right to require that any person to leave the facility immediately and without refund of any fees paid.

CONSENT ON PHOTOGRAPHY

The undersigned agrees that he/she or their minor child may be photographed and consents to the use of any photographs, videos, film, or likeness to be used by the Company for any legitimate business purpose. At any time this consent can be withdrawn my sending an email to admin@runsnwickets.com with the subject line: Withdrawl of Consent on Photography and including the full name of the player, date of birth, age group and phone number in the body of the email.

FACILITY USAGE GUIDELINES AND GENERAL CODE OF CONDUCT

To ensure a safe, clean, and positive environment for developing athletes, all players and parents must adhere to the following guidelines. I understand that failure to comply may result in loss of facility privileges. I also understand these guidelines and code of conduct may change from time to time and will be notified by the Company’s Management Team.

  1. General Facility Rules
    • Check-In Policy: The players and/or the parent must check in on behalf of the player at the front desk upon arrival.
    • Operating Hours: Please arrive no earlier than 15 minutes before your scheduled session time.
    • Restricted Areas: Players and parents must stay in designated areas. Equipment rooms, offices, and maintenance areas are strictly off-limits.
    • Personal Property: The Company is not responsible for lost or stolen items.
  2. Player and Parent Code of Conduct

    We expect our players and parents to represent the spirit of sportsmanship.

    • Respect: Treat coaches, staff, teammates, and opponents with respect at all times. Bullying, hazing, or physical aggression will result in immediate removal.
    • Language: Profanity and abusive language are strictly prohibited.
    • Focus: Be attentive during training. Disruptive behavior wastes your teammates' time.
    • Attire:
      • All enrolled players will attend the sessions in the academy provided jersey and track pants. Any exceptions must be approved by the Coach.
      • Players must wear cricket specific footwear at all times during practice. Parents are allowed to wear any kind of footwear as long as they don’t damage the turf.
  3. Parent & Spectator Guidelines

    Your role is to support and encourage. Please let the coaches coach and the players play.

    • Sideline Behavior: Please remain in the designated viewing area. Do not enter the playing surface (court/turf/field) unless explicitly invited by a staff member.
    • Coaching from the Sidelines: Please refrain from shouting instructions to players. It causes confusion and undermines the professional coaching staff.
    • Disputes: If you have a concern regarding a coach or another player, please do not address it publicly or during a session. Schedule a meeting with the Facility Director to discuss it privately.
  4. Facility Care & Safety

    Help us keep our facility world-class.

    • Food & Drink:
      • Water Only is allowed on the playing surfaces.
      • Food, sports drinks (Gatorade/Powerade), coffee, and soda must be consumed in the lobby/lounge area only.
      • NO CHEWABLES allowed anywhere in the facility.
    • Equipment Usage: Do not misuse facility equipment (e.g., hanging on nets, hitting balls against non-reinforced walls, dragging gear across turf etc.).
    • Trash: Please clean up your bench or seating area before leaving.
  5. Health & Hygiene
    • Illness: If a player or parent has a fever or contagious illness, they must stay home.
    • Injuries: All injuries, no matter how minor, must be reported to a staff member immediately so an incident report can be filed.
    • Spitting: Spitting on the turf or courts is a health hazard and is strictly prohibited.
  6. Pick-Up & Drop-Off
    • Traffic Flow: Please adhere to the designated drop-off lane. Do not park in fire lanes.
    • Punctuality: Parents must pick up players promptly at the end of their session. Staff members cannot be responsible for supervising children more than 15 minutes post-session.
  7. Disciplinary Actions

    Violation of these rules will result in the following steps:

    • Verbal Warning: The individual will be reminded of the policy.
    • Written Warning/Dismissal: The individual may be asked to leave the facility for the day.
    • Suspension/Ban: Repeated or severe violations (such as fighting or vandalism) will result in a membership suspension or permanent ban without refund.

ENTIRE AGREEMENT:

In entering into this Agreement, I am not relying upon any oral or written representation other than what is set forth in this Agreement.

REPRESENTATION:

I represent that I or my minor child, if applicable, is in good health and have no physical limitations that would prevent me or my minor child from participating in vigorous and strenuous activities offered by the Company.

By signing this Acknowledgement of Risk, Waiver of Liability and Release form, the undersigned certifies

I HAVE READ AND UNDERSTAND THIS AGREEMENT AND I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHS, INCLUDING THE RIGHT TO SUE THE RELEASEES. I AM AT LEAST EIGHTEEN (18) YEARS OF AGE AND SIGN FREELY AND VOLUNTARILY. THIS RELEASE SHALL CONTINUE IN FORCE AND EFFECT DURING THIS VISIT AND ALL FUTURE VISITS TO THE FACILITY UNLESS AND UNTIL THE UNDERSIGNED REVOKES THE SAME IN WRITING AND PROVIDES A COPY OF THE SAME TO THE COMPANY.
